The European Union is set to ban the sale of tobacco products in pharmacies for the next four years from 2016.
EU health ministers agreed a three-year ban on tobacco sales at the recent EU Summit on Tobacco.
It follows in line with the landmark Tobacco Products Directive (TPD) of 2002, which prohibits the sale of tobacco products on the market without effective consumer protection. TPD requires health products which can be consumed by adults to have minimum plain packaging in place.
The tobacco ban has now been ratified by the European parliament and a recommendation was sent to the EU Council for a two-year extension, with the deadline for the implementation of the ban set for January 2017.
The ban will apply all tobacco products, including cigarettes, chewing tobacco and cigarillos sold at pharmacies but not at tobacco vending machine or kiosk.
Although the ban will apply only to the tobacco products sold by pharmacies, it has still received some support from the trade unions and other concerned parties.
The European Commission has warned pharmacies against selling tobacco if it means losing the EU’s health directive rights for the pharmacies.
If a member country cannot provide for these rights, the Commission warns that a country will get a second strike on its “trade protection” status.
It is understood that the Council was informed before the vote on the health directive.
Despite its strong opposition, the European Parliament has approved this three year ban on tobacco products from November 14, but the Council of Ministers did not vote while an amendment was proposed. It failed to reach the necessary majority, meaning that it is now an opt-in policy for the period after the ban starts in 2016.
“It is important to avoid another tobacco ban from being enacted that is detrimental to our citizens’ health,” said EU Health Commissioner Janez Potočnik.
But for the tobacco ban to be successful, Member States will need to act fast as the European Parliament requires unanimity on all legislation.
